1. Service Overview

VantageMDM is a global Mobile Device Management solution developed by Infoweise Pty Ltd, an Australian company, to help businesses manage and secure their devices efficiently. It provides both monthly and annual subscription options to meet varied business needs.

2. Eligibility and Intended Use

VantageMDM is exclusively intended for use by businesses to manage company-owned devices or to oversee company data on employee-owned (personal) devices through a separate, secure work profile. It is not intended for personal or non-commercial use. By accessing or using VantageMDM, users confirm they are authorized representatives of their business, with the necessary permissions to implement and manage device oversight on behalf of their organization.

When used on personal devices, VantageMDM limits access strictly to work-related data within the defined work profile. Personal data and applications remain outside the scope of VantageMDM management, ensuring privacy for non-business information on personal devices.

3. Subscription & Payment Terms

VantageMDM is a subscription-based service with flexible payment options:

• Monthly Subscription
• Annual Subscription

Payment is due at the start of each billing cycle. If payment is delayed by more than two weeks, Infoweise Pty Ltd reserves the right to suspend or cancel accounts until the outstanding balance is paid in full.

4. GDPR Compliance & Data Handling

Infoweise Pty Ltd is committed to protecting the privacy of data processed through VantageMDM, with particular care given to meeting the requirements of the General Data Protection Regulation (GDPR) for users in the European Union. Key measures include:

• Data Location : Any work-related data belonging to EU-based users is stored exclusively on servers within the European Union to comply with data residency requirements.
• Data Protection Standards : Infoweise Pty Ltd employs industry-standard security practices and encryption protocols to safeguard data. This includes access control measures, routine security assessments, and compliance with privacy-by-design and privacy-by-default principles under GDPR.
• Data Processing : Infoweise Pty Ltd processes work-related data only as needed to provide and enhance VantageMDM services, in strict compliance with GDPR guidelines. Personal data of users is not accessed if VantageMDM is used on personal devices with separate work profiles.

By using VantageMDM, users acknowledge and agree to this data handling approach as part of the service.

5. Limitations of Liability

To the fullest extent permitted by Australian law, Infoweise Pty Ltd, and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, profits, or reputation, arising from the use or inability to use our services.

Infoweise Pty Ltd strives to provide a high-quality service experience but makes no warranties, express or implied, regarding the performance, reliability, or availability of the service. All implied warranties, including but not limited to merchantability and fitness for a particular purpose, are expressly disclaimed.

Users agree to indemnify, defend, and hold harmless Infoweise Pty Ltd from any claims, liabilities, damages, losses, or expenses, including legal fees, arising out of or in any way connected with the use of our services or a breach of these Terms.

6. Account Termination

Infoweise Pty Ltd reserves the right to terminate or suspend accounts if there is a delay in payment exceeding two weeks or if any of these Terms are breached.

7. Intellectual Property Rights

All content, trademarks, logos, and intellectual property associated with VantageMDM are owned by Infoweise Pty Ltd or its licensors. Users agree not to copy, modify, distribute, sell, or lease any part of the services without explicit written consent.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.

9. Changes to Terms

Infoweise Pty Ltd reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on the website. Continued use of VantageMDM after changes constitutes acceptance of the new Terms.
